I have two complex UC cases which mirror each other and the DWP are not budging from their decision. I was wandering if you can provide advice on how to move this forward with the DWP.

 

Both tenants had children in nursery, they were paying the nursery fee up front and UC paying the 85%.  However UC have stopped paying the nursery fees and repeatedly request for evidence of childcare cost, which they both have submitted numerous times.  However, the DWP stance is that they have submitted the information out of the time and unable to verify the childcare cost – despite both tenants submitted proof showing on their journal.  Both tenant`s situation had not changed prior to the suspension of the childcare cost, so it is not clear why the DWP stopped paying the childcare cost, subsequently placing both tenants in a difficult financial situation.

 

Tenant A

Is a student - her disabled 4-year-old child was in nursery, however due to a dispute with the care provider, mum removed him from their care, as a result she had to give up her job to care for him. 

She was receiving £5K x 3 times a year student finance, the academic year has now finished.

DWP stopped her childcare cost in March, she has continuously supplied all the required information however, the response she gets is – submitted out of the time frame and able to verify her housing cost.  This has been going on since March, and the decision remains the same.

Prior to her taking the child out of nursery she was using the housing cost payment to pay the nursery fee.

She is in receipt of UC – she gets £1444.00 per month, UC are deducting £800.00 per month student loan repayment.  Her monthly rent is £1383.36 which, does not leave her with much to live on.  The £800.00 is an extremely high monthly deduction.

She has submitted a formal complaint to the DWP, but it has fallen on deaf ears.

 

Tenant B

Is an expecting mother – baby due next week.

DWP stopped her childcare cost in February , despite her submitting all the information confirming the childcare cost.

Her child is no longer in nursery as she is too advanced in pregnancy to take him.

They are also deducting £50.00 per month towards a debt which, she stated has been discharged but they say it is a rolling debt!!!!

 

Both tenants are in rent arrears, tenant A is in a worst case as she cannot afford to pay the rent, whilst we are getting APA only for tenant B.

 

Any advice on this will be greatly appreciated.
