A case has recently been heard in Judicial Review proceedings at the High Court about whether the new bedroom tax(or under occupancy in the social rented sector) rules discriminate against disabled people.  10 claimants who are either disabled or live with a disabled person are taking the case jointly. 

The Equality and Human Rights Commission acted as an expert witness and submitted that ‘the new regulations potentially breach the right of people not to be discriminated against in the enjoyment of their rights (A.14) and their right to a family life (A.8).’  ’One of the claimants, who has spina bifida, lives in a two-bedroomed housing association flat with her husband. He is unable to share the same bed because of her health needs. There is not enough space for a second bed so he has to use their second bedroom. ’ We will keep you informed if new   exceptions are confirmed.
