I attended your training a few months back. I have a few questions, I hope you don't mind me reaching out to you.

 

I have a good grasp of Housing Benefit / LHA rates and the rules around bedroom entitlement. I am struggling for information in regards to UC rules around UC Housing Element. 

 

I incorrectly assumed that rules around LHA room entitlement would remain the same as Housing Benefit, but I have been advised via our local authority revenues department that this is not the case. UC have their own rules around Housing Element entitlement.

 

Do you have any general information detailing how UC element is calculated that differs from Housing Benefit please?

 

To give you a basic example:

 

Under HB (before UC housing element) - Two people on benefits (not in a couple) sharing a 2bed RPS property,  joint tenancy, room each, shared facilities, both equally responsible for half the rent each, both over 35.

It was my understanding under HB, as they are sharing facilities the maximum amount they would be entitled to would be the shared facilities LHA rate, regardless of their of age. At least that is what I have been advised in the past.

 

Now under UC Housing Element - I am aware of two individuals, in the same situation as I've detailed above, are receiving self contained LHA rate through Housing Element, despite sharing facilities. 

 

Is it the case that you are entitled to receive a self contained LHA rate due to your age regardless of sharing facilities or not, under UC Housing Element?
