clients become a couple one on PC other on ESA what happens? - Tue, 05/03/2024 - 12:26

Im wondering if you can help me with a UC query.

I saw a lady yesterday Mrs A.  She is 68 yrs old  in receipt of state retirement pension of 203.85 pw, she also recieves enhanced rate PIP both care and mobility. She lives alone in Birmingham and receives pension credit of 294.40 per month. She has a partner Mr B who lives on his own at the moment. He is under pensionable age (age 64 wont receive his SRP until he is 67 ) He is in receipt of ESA of approx £460 every 2 weeks . He  receives support component. He also receives enhanced PIP care and mobility . He lives outside Birmingham. 

They are due to move in together and get married. At the moment Mrs A rents from social landlord but she will move in with Mr B , he is owner occupier.. I understand that as he is under pension age they will not be able to claim pension credit . 

My question is, if she moves in with him can he carry on claiming ESA but claim as a couple? Ive calculated that if they are able to do this they should be able to claim 253.00 pw ESA but if they have to claim Universal credit , their UC will be  24.77 which is a massive difference . Im hoping that they will be able to carry on with ESA. Ive checked online but its not clear
